Request Form for Exercising Rights

Data protection regulations allow you to exercise your rights of access, rectification, objection, erasure, restriction of processing, portability, and not to be subject to automated decisions-making. Through this form, Telefónica offers you the means to request the exercise of your rights in a fast and efficient manner. Please note that the request to exercise your rights is free of charge and will be answered within one month, although, considering the complexity and number of requests, this period may be extended by an additional two months. We inform you that if requests are manifestly unfounded or excessive (e.g., repetitive in nature), Telefónica may refuse to act or, where appropriate, charge a proportional fee. If Telefónica does not process the request, it will inform you, within one month at the latest, of the reasons for not taking action.

Telefónica is fully committed to its customers’ privacy and strives to comply with data protection regulations in the countries in which it operates, as well as to respond to the exercise of the rights received.

To ensure that such exercise is carried out properly and effectively, please note that Telefónica maintains its main electronic communications services in three European countries: Spain, Germany, and the United Kingdom, as well as in Brazil.     We need an email address in order to process your request. Additionally, providing your email address may help us locate your record more quickly, if applicable, and handle your request more efficiently.

    You may include your identification document number to facilitate the processing of your request.

    Access: You have the right to access your data to know which personal data concerning you we are processing.
    Rectification: You may request the modification of any personal data you consider to be inaccurate. (Restriction of processing)
    Erasure: You may request the erasure of your data when, among other reasons, the data are no longer necessary for the purposes for which they were collected, or we are not required to retain them by law.
    Restriction of processing: In certain circumstances, you have the right to request that we restrict the processing of your data. In this case, we will only retain the data for which you have requested restriction for the exercise or defense of claims.
    Portability: In certain circumstances, you have the right to receive the personal data concerning you that you have provided to us, in a commonly used and machine-readable structured format, so that they can be transmitted to another data controller.
    Objection: In certain circumstances, and for reasons related to your particular situation, you have the right to object to the processing of your data. In such cases, we would stop processing your data unless we must continue doing so for legitimate reasons or for the exercise or defense of possible claims. For example, unsubscribing from commercial communications.
    Not to be subject to automated decision-making: This right is intended to ensure that you are not subject to an automated decision based solely on the processing of your data, including profiling, which produces legal effects concerning you or significantly affects you in a similar way.
    Withdraw consent: You may withdraw the consent you have previously given for the processing of your data.
    Other: Any other request not included in the above.

    Basic information on personal data protection

    Data Protection: Telefónica, S.A., as the Data Controller, will process your identifying information, contact details, and any other data you provide in this form in order to manage your request. This processing is based on the fulfillment of a legal obligation. We inform you that your data will be retained for as long as necessary to fulfill the stated purpose and, subsequently, will be blocked for a period of three years in order to demonstrate compliance with regulations; after this period, your data will be deleted. We inform you that we may share your data with other entities within the Telefónica Group if necessary to respond to your request and/or if they are the competent Data Controller. You may exercise your rights of access, rectification, erasure, restriction of processing, and portability through this form or by contacting our Data Protection Officer at [email protected]. If you believe your rights have been infringed, you may lodge a complaint with the Spanish Data Protection Authority.
